1. Acceptance of Terms
By downloading, installing, or using MochaTracker ("the App") you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App. These Terms apply to all users, including Free and Premium plan holders.
2. Description of Service
MochaTracker is a pet health-tracking application that allows users to log medications, bathroom habits, symptoms, appetite, weight, and vet history for their pets. The App is offered as a Free tier (local device storage) and a Premium tier (cloud sync, multi-device, unlimited history, vet export reports) at NZ$4.99/month.
3. Accounts & Registration
Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
Account Security
You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.
Accurate Information
You agree to provide accurate and current information during registration and to keep it up to date.
4. Premium Subscription & Billing
- ✓ Premium is billed monthly at NZ$4.99. Prices include GST where applicable.
- ✓ Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date.
- ✓ You may cancel at any time via the App's Settings screen. Access continues until the end of the billing period.
- ✓ We reserve the right to change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance.
- ✓ Refunds are handled on a case-by-case basis. Contact us within 7 days of a charge if you believe an error has occurred.
5. Acceptable Use
You agree not to:
- ✗ Use the App for any unlawful purpose or in violation of any applicable law.
- ✗ Attempt to reverse-engineer, decompile, or extract source code from the App.
- ✗ Interfere with or disrupt the servers or networks connected to the App.
- ✗ Share your account credentials with others or allow multiple users to access a single account.
- ✗ Use automated scripts or bots to access the App without our prior written consent.
6. Not Veterinary Advice
Important: MochaTracker is a tracking and logging tool only. It does not provide veterinary medical advice, diagnosis, or treatment recommendations. Always consult a qualified veterinarian for your pet's health concerns. Do not delay seeking professional veterinary care based on information recorded in this App.
7. Intellectual Property
The App, including its design, code, branding, and content, is owned by MochaTracker and protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes in accordance with these Terms. You retain ownership of all pet health data you enter.
8. Your Data
You own your pet health data. By uploading data to our cloud servers (Premium) you grant us a limited licence to store, back up, and transmit that data solely to provide the service. We do not use your pet data for advertising or sell it to third parties. See our Privacy Policy for full details.
9. Disclaimers & Limitation of Liability
The App is provided "as is" without warranties of any kind. To the maximum extent permitted by law:
- – We do not warrant that the App will be error-free, uninterrupted, or free from data loss.
- – Our total liability to you shall not exceed the amounts paid by you in the 3 months preceding the claim.
- – We are not liable for any indirect, incidental, or consequential damages arising from your use of the App.
Nothing in these Terms limits any rights you may have under the New Zealand Consumer Guarantees Act 1993 or the Australian Consumer Law that cannot be excluded by contract.
10. Termination
We reserve the right to suspend or terminate your account if you breach these Terms. You may delete your account at any time via Settings. Upon termination, your cloud data will be deleted within 30 days. Free-plan local data remains on your device.
11. Changes to These Terms
We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via email or in-app notification. Continued use after the effective date means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.
